Please write a Mini research essay of 2,000 words (10% margin under or over) on one of the following topics:
1. How does separation of powers (legislative power, executive power and judicial power) under the Commonwealth Constitution operate? What organisations and within what branches of power would be especially important for your future work in business or accounting?
2. What is the division of law-making powers between Commonwealth and States (exclusive powers, concurrent powers and residual powers) under section 51 of the Commonwealth Constitution in the context of business law? Your answer might include discussion of matters relating to stamp duty and land tax, consumer legislation, leasing, income tax matters and employment. These are several examples, your answer might include more areas.
3. Please write an essay in the form of a case note of the following case: Uber B.V. v Commissioner of Taxation [2017] FCA 110. A case note is a summary and analysis of a courts judgment, that means you have to provide information and give your analysis/interpretation of information. The plan to use for the case note is presented in Lecture 2.
