When Sam and Mary Sue, Kansas residents, decided to divorce after fifteen years of marriage, they had two children –a son, Kareem, age thirteen and a daughter, Monique, age eighteen. Sam and Mary Sue intended to benefit their children as part of the divorce decree. As a result they decided that Sam would provide for the post-secondary education of his children with Mary Sue in the event the children decided that they wanted education beyond high school. The divorce decree has a provision requiring Sam to pay and be responsible for all reasonable costs of his children’s post-secondary education. Monique graduated from the University of Kansas in 2013 with a degree in accounting and finished her law degree 2016. Monique sent Sam, her father, a letter detailing the information about her educational debt and requested that Sam pay off the debt. Sam failed to pay any part of the education debt, and Monique sued him in 2017.
